Terms of Service

These Terms of Service explain how Knowcals works, what you can expect from us, and what we expect from you. Using the platform means you agree to them, so it's worth a read.
1. Who We Are and What We Do
Knowcals is a Montana-based online marketplace that connects independent outdoor guides with travelers looking for authentic Montana experiences. We're headquartered in Great Falls. We're a platform — not a guide service. The guides who list on Knowcals are independent business owners. They're not our employees, nor are they independent contractors, and we don't supervise, control, or direct how they run their adventures.
2. Agreeing to These Terms
By creating an account, browsing the platform, or booking an adventure, you agree to these Terms in full. If you don't agree, please don't use the platform. You must be at least 18 years old to create an account or book an adventure. Minors can participate in adventures that allow it, but bookings need to be approved by a parent or legal guardian, who signs the necessary waivers on their behalf.
3. Your Account
You're responsible for keeping your login credentials secure and for everything that happens under your account. Please give us accurate information when you sign up and keep it current. If we believe an account is being used to harm other users or the platform, we may suspend or close it.
4. How the Marketplace Works
Knowcals provides the technology that lets guides and guests find each other, communicate, and transact. When a booking is confirmed, the actual agreement is between the guide and the guest — Knowcals isn't a party to it. We're not responsible for the conduct of any user, the quality or safety of any adventure, or any loss, injury, or damage that arises from an adventure. Guides are solely responsible for the accuracy of their listings, holding any permits or permissions required to operate on public or private land, complying with applicable federal, state, and local law, having an active liability insurance policy, and the safe conduct of their adventures.
5. Bookings and Payments
Payments are processed through Stripe. By booking an adventure, you authorize us to charge the payment method you provide. All prices are in U.S. dollars. Platform fees are collected at the time of booking. If a deposit applies, it's disclosed on the listing page before you confirm the booking. For multi-day adventures, the payment plan and deposit structure are shown on the listing and confirmed in your booking receipt.
6. Cancellations and Refunds
Guest cancellations on single-day adventures - More than 48 hours before the adventure starts: 100% refund - Between 24 and 48 hours before: 50% refund - Less than 24 hours before: no refund Multi-day adventures Cancellation policies for multi-day adventures are set on each listing. The policy that applies to your booking is the one shown before you confirm and included in your booking confirmation. Common policies use 7-day, 14-day, or 30-day cancellation windows with tiered refunds. Guide cancellations If a guide cancels a confirmed booking, you'll get a full refund of everything you paid, including any platform fee. Weather, wildfire, and other things outside anyone's control Knowcals isn't responsible for cancellations caused by weather, wildfire, public land closures, or other conditions beyond a guide's reasonable control. The refund terms for these situations follow the guide's cancellation policy as disclosed at booking.
7. Waivers and Assumption of Risk
Many adventures on Knowcals involve activities with real physical risks — hiking, backcountry travel, rock climbing, paddling, skiing, snowshoeing, wildlife observation, and similar pursuits. You may be asked to sign a digital waiver before your adventure. If a participant is under 18, a parent or legal guardian must sign on their behalf and provide consent. By participating in an adventure, you acknowledge and accept the inherent risks of outdoor activities. To the fullest extent permitted by applicable law, you agree that neither Knowcals nor the guide is liable for injuries, death, property damage, or loss arising from participation in an adventure.
8. Guide Listings and Content
Guides are responsible for the accuracy of their listings. Knowcals doesn't independently verify listing content and makes no representations or warranties about the accuracy, safety, legality, or quality of any adventure. Guides grant Knowcals a non-exclusive, perpetual, royalty-free license to display their listing content (text, photos, videos, and other materials) on the platform and off the platform through all other media for the purpose of operating and promoting the marketplace.
9. Reviews
Guests and guides can leave reviews after a completed booking. Reviews must be honest, based on first-hand experience, and free of harassment, defamation, or retaliation. Knowcals reserves the right to remove or edit reviews that violate these standards.
10. Things You Agree Not to Do
While using Knowcals, you agree not to: - Pay a guide directly to avoid the booking system - Submit false or misleading information, listings, or reviews - Harass, threaten, or discriminate against any user - Use the platform for any unlawful purpose - Attempt to scrape, reverse-engineer, or disrupt the platform We can remove users who break these rules without notice or refund.
11. Intellectual Property
Everything on the platform other than guide-provided listing content — including the design, software, and Knowcals branding — is owned by Knowcals and protected by U.S. copyright, trademark, and other applicable law. Please don't copy, reproduce, or redistribute any of it without our written permission.
12. Disclaimer of Warranties
THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, KNOWCALS DISCLAIMS ALL WARRANTIES, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, KNOWCALS'S TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM OR RELATED TO THESE TERMS OR YOUR USE OF THE PLATFORM SHALL NOT EXCEED THE GREATER OF (A) THE TOTAL FEES PAID BY YOU TO KNOWCALS IN THE 12 MONTHS PRECEDING THE CLAIM OR (B) ONE HUNDRED DOLLARS ($100). IN NO EVENT SHALL KNOWCALS BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS OR DATA.
14. Indemnification
You agree to defend, indemnify, and hold harmless Knowcals and its officers, employees, and agents from any claim, liability, cost, or expense (including reasonable attorney fees) arising from your use of the platform, your listings or bookings, your violation of these Terms, or your infringement of any third-party rights.
15. Governing Law and Disputes
These Terms are governed by the laws of the State of Montana, without regard to its conflict of law provisions. Any dispute arising under these Terms is subject to the exclusive jurisdiction of the state and federal courts located in Cascade County, Montana.
16. Changes to These Terms
We may update these Terms from time to time. When we do, we'll update the "Last updated" date at the top of this page. If you keep using the platform after a change takes effect, that means you agree to the updated Terms. For material changes, we'll let you know by email or in-app notification.
